Right of Withdrawal/Right of Cancellation

The term “right of withdrawal” commonly used in Austria corresponds to the term “right of cancellation” used in Germany and in the Consumer Rights Directive. We therefore use the synonymous pair of terms “right of cancellation (right of withdrawal).” The term “right of withdrawal” is used exclusively in the cancellation policy. This is synonymous with the Austrian term “right of rescission.”

No Right of Withdrawal (Right of Rescission)

There is no right of withdrawal (right of rescission) for goods that are manufactured according to customer specifications or are clearly tailored to personal needs.
The same applies to goods that are liable to spoil quickly or whose expiration date would be quickly exceeded.
There is also no right of withdrawal (right to rescind) for newspapers, magazines, or periodicals (with the exception of subscription contracts).

Loss of the right of withdrawal (right to rescind)

For goods that are delivered sealed and are not suitable for return for health or hygiene reasons, the right of withdrawal does not apply if the goods have been unsealed after delivery.
The same applies to audio or video recordings such as CDs, DVDs, etc., as well as to computer software delivered in sealed packaging. Here, too, the right of withdrawal (right to cancel) does not apply if the goods have been unsealed after delivery.
The right of withdrawal (right to cancel) also does not apply to goods that, due to their nature, have become inseparably mixed with other goods after delivery.
In particular, products are considered unsealed if their original seal or protective film has been removed or damaged.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party designated by you (who is not the carrier), took possession of the last item.

of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail or an email). You may use the attached sample withdrawal form for this purpose, though its use is not required.
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we must refund to you all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same payment method you used for the original transaction to process the refund, unless we have expressly agreed otherwise with you. Under no circumstances will you be charged any fees in connection with this refund.
We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.
The goods must be returned to us or handed over to Friseur & Wellness Oase Silvia Schuh GmbH, Vitiserstraße 7, 3830 Waidhofen an der Thaya, Austria, without delay and no later than fourteen days from the day on which you notify us of your withdrawal from this contract.
The deadline is met if you ship the goods before the fourteen-day period expires.
You are responsible for the direct costs of returning the goods.
You are only liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that goes beyond what is necessary to inspect their condition, characteristics, and functionality.
